1. Acceptance of Terms

By accessing and using Muviee (the "Service"), including our website (muviee.com) and mobile application, you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Eligibility

You must be at least 16 years of age to use this Service. By using the Service, you represent that you meet this age requirement. Users under 18 may have restricted access to certain content features.

3. Account Registration

To access certain features, you must create an account. You agree to provide accurate information and keep it updated. You are responsible for all activity under your account and for maintaining the security of your password. You must notify us immediately of any unauthorized use.

4. User Content

You retain ownership of content you create (reviews, ratings, lists). By posting content, you grant Muviee a non-exclusive, worldwide, royalty-free license to display, distribute, and use your content in connection with the Service.

You agree not to post content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Promotes hate, violence, or discrimination
  • Contains sexually explicit material
  • Infringes intellectual property rights
  • Contains spam, advertising, or solicitations
  • Impersonates another person
  • Contains malware or harmful code

5. Prohibited Conduct

You must not:

  • Create multiple accounts to manipulate ratings or reviews
  • Use automated systems (bots, scrapers) to access the Service
  • Circumvent content filters or security measures
  • Harass, bully, or intimidate other users
  • Manipulate the rating system through coordinated activity
  • Use the Service for any illegal purpose

6. Content Moderation

We reserve the right to remove any content that violates these Terms without notice. We may suspend or terminate accounts that repeatedly violate our policies. Users can report content using the report function available on reviews and comments.

7. Intellectual Property

The Service and its original content (excluding user content) are the property of Muviee. Movie and TV show data is provided by The Movie Database (TMDB). Streaming availability data is provided by JustWatch via TMDB. This product uses the TMDB API but is not endorsed or certified by TMDB.

8. Third-Party Services

The Service may contain links to third-party websites or services (streaming platforms, YouTube, etc.) that are not owned or controlled by Muviee. We have no control over and assume no responsibility for the content or practices of any third-party services.

9. Termination

We may terminate or suspend your account at any time, with or without cause, and with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. You may delete your account at any time through your profile settings. Upon termination, your right to use the Service ceases immediately, and all data associated with your account will be permanently deleted, except as required by law.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT (INCLUDING MOVIE DATA, RATINGS, REVIEWS, OR STREAMING AVAILABILITY INFORMATION) IS ACCURATE, RELIABLE, OR COMPLETE.

You acknowledge that movie metadata, poster images, and streaming availability are sourced from third-party services (TMDB, JustWatch) and may be inaccurate, incomplete, or outdated. We are not responsible for any decisions you make based on this information.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MUVIEE, ITS OPERATORS, OWNERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on the Service, including other users' reviews, ratings, or comments
  • Any content obtained from the Service, including movie data or streaming availability
  • Unauthorized access, use, or alteration of your account or content
  • Any bugs, viruses, or other harmful code transmitted through the Service

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100 USD), WHICHEVER IS LESS. THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless Muviee, its operators, owners, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any content you submit, post, or transmit through the Service

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved informally within thirty (30) days, it shall be submitted to binding arbitration in accordance with the rules of the jurisdiction in which Muviee operates. You agree to waive any right to a jury trial or to participate in a class action.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via the Service or email. Continued use after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Muviee operates, without regard to conflict of law provisions. Any legal action must be brought within one (1) year after the cause of action arises.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Muviee regarding the Service, and supersede all prior agreements, communications, and understandings.
